Elder Abuse Lawyer

Elder abuse can take place anywhere that an elderly person lives. It can occur in the home, where family members or caregivers cause harm and take advantage of an elderly person, or in an institutional setting such as a nursing home or long term care facility where the person has been entrusted to the supervision and care of professionals who are being paid to provide them with help. When elder abuse takes place it represents a tremendous betrayal of trust.

Elderly people are often in poor health, frail and extremely vulnerable to people bulling them or taking advantage of them, and are often too afraid of the perpetrator and possible retribution to report that they are being harmed in anyway.

If you suspect that someone you care about is being abused by a caregiver or neglected by the staff of the institution where they are residing, call the attorneys at Danziger & De Llano for help. We have years of experience with holding wrongdoers of all types accountable and making them pay for the damages they’ve done, and our knowledgeable elder abuse lawyers can help you too.

What is Elder Abuse?

Elder abuse can take many forms and can take place in a number of environments, and there are many reasons why it can take place.

Unfortunately, in many cases elder abuse in the home is perpetrated by a family member or neighbor, but when elder abuse takes place in a long-term care setting where the senior citizen has been placed for their own health and benefit, that means that somebody who is being paid to provide care is responsible for their abuse.

The institution is as liable as their employee for any damage caused by their behavior. The different types of elder abuse that can take place in a nursing home setting are:

  • Physical Abuse. This is action that is taken to intimidate or hurt the elderly person, and can include pushing them, hitting them, restraining them or drugging them.

  • Emotional Abuse. This is verbal assault designed to embarrass, humiliate or intimidate the elderly person. Though emotional abuse does not leave physical scars, it is psychically extremely damaging, and can leave the senior terrorized. Neglect and isolation are other forms of emotional abuse that can be equally painful.

  • Sexual Abuse. This is largely having sex with or fondling an elder without their permission, but can also include showing them pornography, forcing them to watch other people have sex, or making them remove their clothes.

  • Financial elder abuse. The elderly are often very trusting, and can be manipulated into schemes, into agreeing to provide money to fake charities and other ruses. Money can also be stolen through forgery, identity theft, or outright theft.

  • Neglect. Perhaps the most insidious form of elder abuse, it involves leaving the person unattended so that they are isolated, hungry, dehydrated and at risk.

Elder abuse is illegal, and if you suspect that someone you care about is a victim then you need to take action and get them help. Call the experienced nursing home abuse law firm of Danziger & De Llano and we’ll get started immediately.

Signs of Elder Abuse

If you have a loved one residing in a nursing home or long-term care facility, the fear of nursing home abuse or nursing home neglect is probably one of your greatest concerns. Because the elderly are often unable or too afraid or ashamed to let people know that they are being victimized, keeping your eyes open for signs of trouble is the only thing that you can do. The most common signs of elder abuse and neglect include:

In many cases, problems of elder neglect are the result of understaffing on the part of the nursing home or institution, while elder abuse is often a matter of staff members being frustrated, overworked and undereducated as to the special needs of senior citizens. Understaffing and lack of education are a recipe for disaster.
